Welcome to ‘job4online.com.au’ (the Site). The Site is a digital platform provided by Job4 Online Pty Ltd (ABN [54 664 891 856], referred to as "we", "us", or "our").

For the purposes of these Terms & Conditions, Job4Online Pty Ltd is an Australian Private Company incorporated in, and under the laws of, the Commonwealth of Australia.

These Terms & Conditions (Terms) govern your access to and use of the Site and its related services. By accessing or using the Site in any manner (including browsing), you agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

Please read these Terms carefully before using the Site. If you do not agree to these Terms, you must not access or use the Site.

Use of the Site

  • Eligibility: You must have the legal capacity to enter into a binding agreement to use the Site. If you are using the Site on behalf of an entity (e.g., as an employer), you represent that you have the authority to bind that entity to these Terms.
  • License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purposes (connecting job seekers and employers) in accordance with these Terms.
  • Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You must not share your login details or create more than one personal account.
  • Acceptable Use: You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. You agree to be reasonable in the volume of applications, postings, or other submissions you make via the Site.
  • Accuracy of Information: You are solely responsible for the accuracy, completeness, and legality of any information or content you submit to the Site (including resumes, job descriptions, profile information). You warrant that all information provided by you is truthful, accurate, and up-to-date to the best of your knowledge and is provided in good faith.

Communications and Notifications

  • Communication Channels: By using the Site, you agree that we may communicate with you through various channels including email, SMS (text messages), and WhatsApp, subject to your communication preferences and applicable laws.
  • Phone Number Verification: To enable certain features (including WhatsApp notifications), you may be required to verify your phone number. We will send a one-time verification code via SMS to confirm your phone number. Standard SMS rates from your mobile carrier may apply. You acknowledge that:
    • The verification SMS is sent solely to confirm ownership of the phone number.
    • You are responsible for any charges from your mobile carrier for receiving SMS messages.
    • The verification code is valid for a limited time (typically 10 minutes) and should not be shared with others.
  • WhatsApp Communications: If you choose to enable WhatsApp notifications and verify your phone number, you consent to receive notifications and messages from us via WhatsApp. WhatsApp notifications may include job alerts, application updates, job posting updates, and marketing communications based on your preferences. You can disable WhatsApp notifications at any time through your account settings.
  • SMS Usage: We use SMS exclusively for phone number verification purposes. We will not send marketing messages or promotional content via SMS unless separately required by law or for account security purposes.
  • Notification Preferences: You have control over your notification preferences and can manage which types of communications you receive through email, SMS (where applicable), and WhatsApp. You can update these preferences at any time through your account settings in the "Notifications" section.
  • Opt-Out Rights: You may opt out of receiving promotional communications at any time by updating your preferences in your account settings, clicking unsubscribe links in emails, or contacting us directly. However, you may not opt out of receiving essential service-related communications (such as account verification, security alerts, or important policy updates).

Document Verification for Casual Workers

For users seeking casual employment opportunities through the Site, additional verification may be required to comply with Australian employment laws and regulations:

  • Work Eligibility Documentation: Casual job seekers may be required to provide documentation to verify their legal right to work in Australia, including but not limited to:
    • Australian citizenship documents (passport, birth certificate, citizenship certificate)
    • Visa Entitlement Verification Online (VEVO) records or visa documentation
    • Other documents as required by Australian immigration and employment laws
  • Document Handling: You acknowledge and agree that:
    • All documents submitted must be genuine, current, and unaltered.
    • We may verify the authenticity of submitted documents with relevant government agencies.
    • We will handle your documents in accordance with our Privacy Policy and applicable privacy laws.
    • Providing false or fraudulent documentation may result in immediate account suspension or termination and may be reported to relevant authorities.
  • Employer Obligations: Employers using the Site to hire casual workers remain responsible for conducting their own verification of work eligibility and complying with all applicable employment laws, including Fair Work Act 2009 requirements.

Prohibited Conduct and Content

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable laws or regulations.
  • Submit, post, or transmit any content that is:
    • False, misleading, deceptive, or fraudulent.
    • Defamatory, abusive, harassing, threatening, or invasive of privacy.
    • Obscene, pornographic, or offensive.
    • Discriminatory based on race, religion, gender, sexual orientation, age, disability, or any other protected characteristic.
    • Infringing upon any third party's intellectual property rights (copyright, trademark, patent, trade secret).
    • Containing viruses, malware, or other harmful code.
    • Unsolicited advertising, spam, or junk mail.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Attempt to gain unauthorized access to the Site, other user accounts, or computer systems or networks connected to the Site.
  • Interfere with or disrupt the operation of the Site or servers or networks connected to the Site.
  • Use any automated means (robots, spiders, scrapers) to access the Site for any purpose without our express written permission, unless explicitly permitted by standard search engine protocols.
  • Violate these Terms or our Privacy Policy.

We reserve the right, but have no obligation, to monitor content submitted to the Site and to remove any content or suspend/terminate any user account that we deem, in our sole discretion, to be in violation of these Terms or otherwise inappropriate.

Intellectual Property

  • Our Content: The Site and its original content (excluding user-submitted content), features, and functionality (including text, graphics, logos, icons, images, software) are and will remain the exclusive property of Job4 Online Pty Ltd and its licensors, protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Site or included software, nor may you reverse engineer or attempt to extract the source code, without our express written permission.
  • User Content: By submitting content (e.g., resumes, job postings, profile information) to the Site, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with operating the Site and providing our services. You represent and warrant that you have the necessary rights to grant this license for any content you submit. You retain ownership of your content.

Disclaimers and Limitation of Liability

  • "As Is" Basis: The Site is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Your use of the Site is at your own risk.
  • No Endorsement: We do not endorse, guarantee, or assume responsibility for the accuracy, reliability, or legality of any user-submitted content (including job postings or resumes), nor do we guarantee any employment outcomes. We are not a party to any agreements entered into between users (e.g., employment contracts). Any interactions or transactions between users are solely between those users.
  • Limitation of Liability: To the fullest extent permitted by applicable law, in no event shall Job4 Online Pty Ltd, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
    • Your access to or use of or inability to access or use the Site.
    • Any conduct or content of any third party on the Site (including other users).
    • Any content obtained from the Site.
    • Unauthorized access, use, or alteration of your transmissions or content.
    • Any other matter relating to the Site. This limitation applies regardless of whether the alleged liability is based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damage.

Indemnification

You agree to defend, indemnify, and hold harmless Job4 Online Pty Ltd, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any user content you submit, any use of the Site's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.

Termination

We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of the Site, without notice, for any reason, including, without limitation, breach of these Terms. Upon termination, your right to use the Site will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Australia, without regard to its conflict of law principles. You irrevocably agree to submit to the exclusive jurisdiction of the courts located within the Commonwealth of Australia to resolve any dispute arising out of or relating to these Terms or the Site.

Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Changes to Terms & Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we may attempt to provide notice prior to any new terms taking effect (e.g., via a notice on the Site or email), but we are not obligated to do so. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Site.
